Scope

This Acceptable Use Policy & Disclaimer (the “Policy”) applies to everyone who uses:

  • andorainnovationslimited.com (the “Website”), including its contact forms and live chat; and
  • any website, application, server, network or other system that Andora Innovations Limited (“Andora”, “we”, “us”) hosts, manages or supports for a client (“Managed Systems”).

The Policy forms part of our Terms and Conditions. By using the Website or a Managed System, you agree to it. Clients are responsible for ensuring that their personnel, customers and other users of Managed Systems comply with it.

Prohibited use

You must not use the Website or any Managed System to do any of the following, or attempt or help anyone else to do so:

  • access any computer system, account or data without authorisation, or exceed your authorised access (sections 14 and 15 of the Computer Misuse and Cybercrimes Act, 2018);
  • interfere with, or intercept, any computer system, program or data without authorisation (sections 16 and 17 of that Act);
  • scan, probe, or test for vulnerabilities in, any system without our prior written permission (see Responsible disclosure);
  • introduce viruses, ransomware, malware or other harmful code, or distribute tools or access codes intended for committing offences (section 18 of that Act);
  • overload or disrupt the Website or our infrastructure, including through denial-of-service attacks, automated bulk requests or crawling that ignores our robots.txt;
  • scrape or harvest content, email addresses or other personal data, in breach of the Data Protection Act, 2019;
  • send spam, phishing messages, unsolicited commercial communications or fraudulent content through our forms, chat or email;
  • impersonate any person or organisation, or misrepresent your identity or affiliation;
  • publish or transmit content that is unlawful, defamatory, obscene, hateful, or that amounts to cyber harassment (section 27 of the Computer Misuse and Cybercrimes Act, 2018);
  • infringe any copyright, trade mark or other intellectual property right, including under the Copyright Act, 2001 and the Trade Marks Act; or
  • engage in any other activity that is unlawful in Kenya, or in the jurisdiction from which you access the Website.

Managed Systems and enforcement

Clients are responsible for all content and activity on Managed Systems. We may investigate suspected breaches of this Policy. We may suspend or restrict a Managed System, account or service, in whole or in part, where it:

  • is being used for unlawful activity or in breach of this Policy;
  • is distributing malware, spam or phishing content; or
  • poses a risk to the security, integrity or availability of other systems or users.

Where practicable, we will give notice and a reasonable opportunity to remedy the problem first. We may act without notice where there is an urgent security risk or a legal requirement. We will restore the service once the issue is resolved.

We may preserve relevant records, and report suspected offences to, and co-operate with, law enforcement agencies and regulators, including the National Computer and Cybercrimes Co-ordination Committee and the Office of the Data Protection Commissioner, where the law requires or permits.

Responsible disclosure

If you believe you have found a security vulnerability in the Website or our systems, please report it to info@andorainnovationslimited.com with the subject “Security report”, including enough detail for us to reproduce it. When researching and reporting, you must:

  • not access, modify, copy or delete data beyond the minimum needed to demonstrate the issue, and not keep any personal data you encounter;
  • not disrupt our services or anyone else’s, and not use denial-of-service, social engineering or physical attacks;
  • give us a reasonable period, normally ninety (90) days, to fix the issue before disclosing it to anyone else; and
  • comply with the law at all times.

We will acknowledge your report within five (5) business days, keep you informed of our progress, and credit you if you wish. Where you act in good faith and within these rules, we will not initiate legal action against you, and we will not report your research to law enforcement. This does not authorise testing of any client’s Managed Systems, which requires that client’s written permission.

Website disclaimer

Content on the Website is general information about our services. It is not professional, legal, financial or technical advice, and you should not rely on it as such.

Figures such as delivery timelines, performance targets and typical results are estimates based on past experience, not guarantees. Actual outcomes depend on each engagement’s scope and circumstances, and are governed by the applicable Agreement.

The Website is provided “as is” and “as available”. To the fullest extent permitted by law, we give no warranty that it will be complete, accurate, current, uninterrupted, secure or free of errors or harmful components. We are not liable for any loss arising from reliance on Website content, except where liability cannot lawfully be excluded, including under the Consumer Protection Act, 2012.

AI chat assistant

Our live chat includes an AI assistant (Lyro, by Tidio) that answers common questions automatically. Its answers may be incomplete or inaccurate. They are not quotations, offers, commitments or professional advice, and they do not bind Andora. Only a written Proposal issued by our staff can do that. Please confirm anything important with our team in writing, and never share passwords, payment card details or other sensitive information in the chat.

Portfolio and case studies

Our portfolio presents work delivered by Andora and members of our team. Client websites and systems we link to are owned and operated by those clients. We may no longer maintain them, and their content may have changed since we delivered our work. Client names and marks are shown with permission, or as factual references, and remain the property of their owners.

External links

The Website links to third-party websites, including client projects, WhatsApp and government resources. We do not control them, and we are not responsible for their content, availability, security or privacy practices. A link does not imply our endorsement.

Intellectual property

The Website, including its text, design, graphics, code, and the Andora name and logo, is owned by Andora Innovations Limited or used under licence. It is protected by the Copyright Act, 2001 and other intellectual property laws.

You may view and print pages for your own non-commercial reference. You may not copy, reproduce, republish, frame or otherwise use Website content or our brand for any other purpose without our prior written permission. Other product names, platforms and trade marks belong to their respective owners.

Changes and contact

We may update this Policy from time to time. The “Last updated” date at the top shows when it was last revised, and continued use of the Website after a change means you accept the updated Policy. To report abuse or ask about this Policy, email info@andorainnovationslimited.com or call +254 710 337 605.
